Terms of Use

Healthcare Web Summit
Healthcare Web Summit (HWS) is a service of Managed Care On-Line, Inc. (MCOL). HWS offers health care business professionals educational and learning events including webinars. The MCOL Terms of Use explain and set forth our policies regarding your participation in the HWS Web Site and HWS Events.

Your Acceptance of These Terms
By using the HWS Web Site and or participating in HWS Events, you signify your acceptance of all provisions of the MCOL HWS Terms of Use as set forth herein. If you do not agree to the terms of the MCOL Terms of Use, please do not use the Web Site or participate in HWS Events. HWS will refund any Event registration fees paid if you notify HWS in advance of an Event that you do not agree to these terms. Your continued use of the MCOL HWS Web Site or Events following the posting of changes to these terms will mean that you accept those changes. If you have questions or concerns regarding the MCOL HWS Terms of Use, please contact MCOL as directed below.

Compliance with the Law
You must comply with all applicable governing laws at all times regarding your use of this Web Site and participation in HWS Events.

Privacy Policy
The MCOL HWS Privacy Policy applies to your and other users use of the Web Site and participation in HWS Events, and MCOL management of the Web Site and HWS Events. The Privacy Policy is provided herein.

Individual Registration and Use
Unless an attendee has registered under a site license as designated by MCOL, their registration is limited to their individual use as follows:

  1. Webinar participation access is limited to one designated phone line (when applicable) and/or one online internet session. The registrant may include additional persons in the same room to listen to the audio via speakers, and view the session online. Additional phone lines and or online internet sessions require separate individual registration or a designated site license.
  2. HealthcareWebSummit downloadable materials, in whole or part, may not be copied, e-mailed, or made available to multiple persons via a network, intranet or via the internet unless so authorized by a designated site license.

MCOL Basic Membership
Attendees also receive a complimentary MCOL Basic membership with their registration for any Healthcare Web Summit event.

Refusal of Service and Content
MCOL reserves the right, at its sole discretion, to refuse to honor any request for Registration of Event participants, any request for Subscriptions to HWS e-mailings, or any requests to participate in HWS Event Faculty. Furthermore MCOL reserves the right to terminate any user Registration or Subscription at any time, deny access to the Web Site or an Event to a specific user(s) or to delete any Content at any time.

No Guarantee Regarding Content Validity and Accuracy
The learning content of the HWS Web Site and HWS Events is provided by third party faculty. Please be advised that the learning content has not necessarily been reviewed by MCOL or peer reviewers with the expertise required to provide you with complete, accurate or reliable information, and that furthermore, a portion of the content by its nature, is opinion, and not fact-based. MCOL cannot guarantee the validity or accuracy of the HWS Web Site, e-mail, or Event content. MCOL at its sole discretion may also choose to remove any content from the Web Site at any time.

Advertisers and Sponsors
MCOL accepts paid advertising and sponsorships regarding the Web Site, HWS e-mailings and HWS Events. Advertisements may appear as banner (image) or text advertising on various web pages or e-mailings. While banner advertising should be readily apparent to uses, banner ads may not be clearly labeled as "Advertisements." Any text only advertising will include a label identifying the text as an advertisement or sponsor message.  HWS also may offer sponsored Events, in which sponsoring organizations provide faculty and content for the Event. Sponsoring organizations will be indicated in general Event information provided by HWS.

Copyright Provisions
You agree at all times to honor all applicable copyright law with respect to HWS Web Site and Event content including Event faculty audio and visual presentations and companion materials, and Event CD-ROMs or flash drives. Furthermore, the following provisions apply to use of the HWS Web Site and HWS Event participation:

  1. You may not duplicate, license, sublicense, publish, broadcast, transmit, distribute, perform, display, sell, rebrand, otherwise transfer or commercially exploit HWS Web Site and Event Content (excluding any content provided by you) except as specifically authorized in writing by MCOL.
  2. You may not remove any copyright, trademark or other proprietary rights notices contained in or on the Web Site HWS e-mailings or HWS Event materials.
  3. You may not infringe or use the HWS or MCOL brand, logos and/or trademarks without authorization.
  4. If you are a HWS participating Faculty member, you hereby grant MCOL the continual right to publish content and audio and visual presentations you provide for your applicable HWS Event in the HWS Web Site and HWS media including downloadable materials.

Registration Eligibility
If you Register for an HWS Event, you represent and warrant that you (a) are not under the age of 18; (b) have not previously been suspended or removed from Registration by MCOL; (c) are not registering under a false name or with false information; (d) will keep your Event passcodes confidential, will not use other Users’ accounts and will not let others use your account; (e) will not attempt to or actually override any security component included in the Web Site or Events; and (f) will comply with the HWS Terms of Use at all times.

Indemnify MCOL
You agree to indemnify MCOL and hold MCOL harmless from any damages, losses and costs (including, but not limited to, reasonable attorneys’ fees) related to third party claims, charges or investigations, caused by your failure to comply with the HWS Terms of Use, including, without limitation, your violation of copyright law that violates third party rights or applicable laws.

Disclaimers
MCOL does not guarantee that the HWS services which it provides will function without interruption or errors in functioning. MCOL may modify, replace, refuse access to, suspend or discontinue the HWS Web Site or HWS Events, partially or entirely. MCOL will issue refunds to paid Event participants for any cancelled Event or Event with service interruption disrupting the majority of the scheduled Event time. MCOL reserves all rights not expressly granted herein, including, without limitation, title, ownership, intellectual property rights, and all other rights and interest in MCOL's HWS and all related items. MCOL neither warrants nor represents that your use of the Web Site or participating in HWS Events will not infringe the rights of third parties.

Notification of Changes
The MCOL HWS Terms of Use may be revised over time. The most recent update date of this policy will always appear at the beginning of this policy. We do, however, recommend that you read the MCOL HWS Terms of Use each time you use this Web Site.

The MCOL HWS Privacy Policy explains how we may collect, use and aggregate personal information about you on the Web Site and Event registrations, and describes the limitations we have placed on use of your personal information, and the protections we have implemented regarding the privacy of your personal information.

Your IP Address
For each visitor to the Web Site, MCOL's servers automatically utilize a hit counter and record the IP address or domain name. We use your IP address to help diagnose problems with our server and to administer the Web Site. Your IP address and domain name are anonymous (they do not reveal your personal identity) and are not shared with any third party, except when you specifically elect to disclose your e-mail address in content you submit as discussed below.

Registration and Subscriptions
The Web Site and HWS offices provide you with the opportunity to register to participate in Events or subscribe to e-newsletters as described in the Web Site. By registering, you agree to receive HWS announcements and e-newsletters as described in the Web Site, and to subscribe to a MCOL Basic membership, as described in www.mcol.com. You may opt out of the MCOL memberships, and or from receiving e-mail information from MCOL (see the Opt-Out Procedures section below.)

Limitation on use of collected information
MCOL may provide individual Member or Subscriber email addresses and or other contact information to entities with an ownership interest in MCOL or entities that MCOL also shares an ownership interest in. MCOL will not otherwise sell, exchange or share e-mail addresses and other contact information registered or subscribed from the Web Site or HWS Event registrations to any other party or organization without the explicit permission of the user, except sharing of attendee information for a specific HWS Event with the faculty and any sponsors of that specific Event. MCOL reserves the right to transfer title of its e-mail and other contact information to a third party at any time.

Data Integrity and Purpose Limitation
Personal information you provide to us is used to process your registration, manage your account, deliver the services you request (including communicating with you about your registration), and to respond to your inquiries and contact you our content and services on the basis of your consent and may be used in a number of ways including registration and attendance at HWS events, or MCOL or HWS announcements, including e-newsletters; and to access certain features or functions of our content. MCOL takes reasonable steps to ensure that the personal data that it processes is: (i) relevant for the purposes for which it is to be used, (ii) reliable for its intended use, and (iii) accurate, complete and current. MCOL uses reasonable technological and physical safeguards to protect your personal information from loss, misuse and unauthorized access, disclosure, alteration and destruction. MCOL follows generally accepted industry standards to protect the information submitted to us, both during transmission and once received. The MCOL Data Privacy Officer has primary responsibility to oversee MCOL processing of personal data in this regard. You can request to directly contact the MCOL Data Privacy Officer by contacting MCOL as set forth below.

Links
The Web Site contains links to other sites. MCOL is not responsible for the privacy practices or the content of such Web Sites, including any sites that may indicate a special relationship or partnership with MCOL, such as co-branded pages and "powered by" relationships. MCOL does not disclose Contact or Payment Information to those responsible for the linked sites. The linked sites, however, may collect personal information from you when you link to their site. This collecting of information is not subject to MCOL's control. To ensure protection of your privacy, always review the privacy policy of the sites you visit by linking from our Web Site.

Notification of Changes

Correcting, Updating or Deleting Information
MCOL also permits you to correct, update or delete personal Information that you have previously provided to us. To do so, contact MCOL indicating the contact information that you wish to be corrected, updated or deleted, and MCOL will process your request in accordance with the provisions set forth in this policy. You may also request MCOL to send you an electronic copy of your personal data for your review.

Opt-Out Procedures
You may always opt-out of receiving future e-mails from us. To remove your Contact Information from our database, and to cancel future communications, send an e-mail to mcare@mcol.com specifically indicating if you request to unsubscribe from HWS e-mail news and announcements. This Opt-Out will remove you from HWS distribution lists, but would not remove you from any other distribution lists unrelated to that you subscribed to separately with MCOL through other MCOL Web Sites. If you wish to opt-out of MCOL memberships and or e-newsletter distribution provided with your HWS Event registration, you may do so at anytime by notifying MCOL via e-mail (mcare@mcol.com) or phone 209.577.4888. MCOL also provides separate opt-outs at any time for any other MCOL distribution lists.

Your Rights
You have the right to:

  • Withdraw your consent to the processing of your personal information at any time without penalty;
  • Access your personal information and have it corrected, amended or deleted;
  • Receive a copy of your personal data and transit such to others;
  • At any time, to object to our processing of your personal information which we will comply with unless we demonstrate a compelling legitimate grounds for processing such that overrides your rights; and
  • If you believe your personal information is inaccurate, unlawful, no longer necessary for our business purposes, or if you object to our processing of your personal information, you also have the right to instruct us to restrict the processing of your data pending our investigation and/or verification of your claim.
  • If you wish to raise a complaint and initiate an investigation on how we have handled your personal data, or request a copy of your personal information, please contact us. We reserve the right to impose a charge for any direct external costs we would incur in responding to your request.
