Employees often engage in unhealthy behavior. Some may smoke. Some may eat poorly. Many fail to exercise regularly. Unhealthy behavior outside the office can often lead to increased health plan costs for the employer. How can employers effectively regulate employee behavior as a means to reducing health care costs and perhaps even absenteeism?

Many employers implement wellness and disease management programs as a way to influence healthy behavior. However, most employers and their third party administrators typically overlook the subtle compliance issues that arise in connection with a successful wellness promotion/prevention program. What may seem to the untrained eye as an innocuous program with nothing but advantages to the employees may run afoul of federal rules such as HIPAA nondiscrimination and privacy, the Americans With Disabilities Act and a variety of state laws.
