Overview
  
The Centers for Medicare & Medicaid Services (CMS) announced they are about to publish proposed Accountable Care Organization (ACO) regulations under the Affordable Care Act's Shared Savings Program. The regulations are expected to address a range of issues regarding various aspects of ACO arrangements and operations under the program, which have not been given significant detailed guidance to date.

Douglas A. Hastings currently serves as Chair of the Board of Directors of Epstein Becker & Green, P.C. He is a Member of the Firm's Health Care and Life Sciences Practice in the Washington, DC office. Mr. Hastings provides a wide range of health care organizations with strategic and transactional legal guidance in responding to the legal challenges and opportunities of the rapidly changing U.S. health care system.

Mr. Hastings serves on the Board on Health Care Services of the Institute of Medicine and is a member of the Advisory Board of the BNA's Health Law Reporter. He served on the Board of Directors of the American Health Lawyers Association from 1991 to 2003, and was President of that organization for 2001-2002.

Mr. Hastings' clients include academic medical centers; hospitals and health systems; faculty practices, medical groups and other physician organizations; health plans and other managed care organizations; long-term care facilities; investment banks and venture funds; and other health care-related entities. He focuses on representing these organizations in mergers, acquisitions, joint ventures, governance issues, complex contractual arrangements and other affiliations and collaborative efforts. Mr. Hastings and his colleagues also provide his clients with a full range of legal advice and services, including: antitrust law; Medicare reimbursement and other third party payment issues; Stark, fraud and abuse, and other health care compliance issues; tax and tax-exempt counseling; privacy law; bankruptcy and restructuring; real estate and construction law; labor and employment law; and liability and litigation matters.

Mr. Hastings has been named by Best Lawyers as the "Washington, DC Health Care Lawyer of the Year" for 2010. He is listed in Chambers USA Leading Lawyers for Business, The Best Lawyers in America, Washington DC Super Lawyers, and Who's Who in American Law. In 2006, Mr. Hastings was named one of the DC Area's Top Life Sciences Attorneys by the Legal Times. In 2004, Nightingale's Healthcare News listed him as one of the nation's leading healthcare transaction lawyers. In 1997, the National Law Journal named him as one of "40 Health Care Lawyers Who Have Made Their Mark." From 1991 through 1999, he served as Program Chair of the Managed Care Law Institute of the American Health Lawyers Association. He is a graduate of Duke University and the University of Virginia Law School.

Mr. Hastings speaks and publishes regularly on topics related to health care law, complex health care transactions, corporate governance, collaborative health care ventures, legal issues related to quality improvement and the legal trends influencing the U.S. health care system.
  


 
 
David Matyas

David E. Matyas

  David E. Matyas is a Member of EpsteinBeckerGreen in the Health Care and Life Sciences Practice in the firm's Washington, DC office. He practices in the firm's Health Care Fraud Practice Group, which focuses on federal and state fraud issues such as anti-kickback, self-referral, false claims and regulatory compliance. Mr. Matyas also practices in the firm's Third-Party Payment Practice Group, which concentrates on legal and regulatory matters arising under Medicare, Medicaid, and other third-party payment programs. Mr. Matyas represents an array of health care providers including hospitals and health systems, pharmaceutical and medical device manufacturers, academic medical centers, retail and specialty pharmacies, ambulatory surgery centers, home health agencies, and physician organizations. He also advises investors and other financial institutions that invest in or support the health care industry.

Mr. Matyas: Represents and defends health care entities in connection with government audits and investigations; • Helps clients develop, implement and evaluate health care corporate compliance programs; •Counsels clients in planning and structuring transactions and business arrangements to minimize fraud and abuse and understand reimbursement implications in matters related to health care transactions; •Advises clients on legal and regulatory matters in connection with investment documents, offering memoranda, filings with the SEC and other transactional documents; •Participates in administrative rulemaking processes.

From 2005-2008, Mr. Matyas had been appointed by the Secretary of the Department of Health & Human Services to the Advisory Committee on Blood Safety & Availability, which provides advice on broad public health, ethical and legal issues related to the nation's supply of blood and blood products. From 2002-2008, Mr. Matyas served as a member of the Board of Directors for the American Health Lawyers Association, and he continues to chair the association's Fundamentals of Health Law Program.

In 2005 and in 2010, Mr. Matyas was selected by the editors of Nightingale's Healthcare News as one of the "Outstanding Fraud & Compliance Lawyers." Mr. Matyas is also listed in the District of Columbia Healthcare category of Chambers USA and in Washington, D.C. Super Lawyers magazine.

Mr. Matyas has served as an Adjunct Professor of Law at American University's Washington School of Law. He is a frequent speaker and author on the subjects of health care fraud, corporate compliance programs, the Stark Law, mergers and acquisitions in the health care industry, and other health-related topics. Mr. Matyas is the co-author of the book entitled Legal Issues in Health Care Fraud and Abuse: Navigating the Uncertainties, of which the 3rd edition was published in 2006.

  Patricia M. Wagner is a Member of EpsteinBeckerGreen in the Health Care and Life Sciences Practice in the firm's Washington, DC office.
